29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a) The employer failed to provide certification for abatement of citation 1 item 1a in which employees were not provided fall protection while exposed to a fall hazard of greater than 13 feet. Condition observed on or about 10/21/2014.  b) The employer failed to provide certification for abatement of citation 1 item 1b in which the employer had not trained each employee exposed to fall hazards to recognize the hazards and the procedures to minimize these hazards. Condition noted on or about 10/21/2014.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a)  146 Preservation Blvd., Chesterfield, NJ: On or about 10/21/2014 five employees of Constructec Corporation were observed sheathing the second story floor decking of a multi-story new construction residence.  The workers were observed walking the floor joists and exterior wall top plates without any form of fall protection and were thus exposed to a fall hazard of greater than 13 feet.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
