Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration or other fire hazards from ignition of combustible dust in ungrounded dust conveyors. a) Building 71, dryer D-7108 conveyor Two grounding wires for the conveyor from dryer D-7108 to packaging were not connected. The conveyor carried Polyphase P-100 powder, a Class II explosive dust. Violation occurred on or about 10/24/14.

29 CFR 1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX were not used in locations where volatile flammable liquids or flammable gases were handled, processed or used, but in which the hazardous liquids, vapors or gases were normally confined within closed containers or closed systems from which they could escape only in case of accidental rupture or breakdown of such containers or systems, or in the case of abnormal operation of equipment: a) Building 71, bagging area nearest Part I reactor. A Crown LPS propane forklift was used to remove product from the bagging area which has an electrical classification of Class 1 Division 1. Violation occurred on or about 10/24/14.
