29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: On or about December 9, 2014, and at times prior thereto, the employer did not provide training for four employees performing activities including, but not limited to, working on the roof of the newly constructed house without any form of fall protection and were exposed to a fall hazard greater than 6-feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about December 9, 2014, and at times prior thereto, four employees were observed working on the roof of the newly constructed house without any form of fall protection, one of the employees on the roof was also the company superintendent, and all were exposed to a fall hazard greater than 6-feet. Tovar Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 593498, citation number 1, item number 001 and was affirmed as a final order on January 4, 2013 with respect to a workplace located at 505 Emerald Green, El Paso, TX 79928. Tovar Roofing was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 477418, citation number 1, item number 001 and was affirmed as a final order on October 10, 2012 with respect to a workplace located at 6528 Latimer, El Paso, TX 79932.
