29 CFR 1915.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI): a) 1818 Brown Ave., Norfolk, VA 23504, Vessel APL-50: On or about December 5, 2014, and times prior thereto, the employer did not make an initial determination for employee exposure to chromium (VI) where employees performed grinding, cutting and welding tasks that generated Cr(VI)-containing dust and/or fumes, exposing employees to increased risk of respiratory irritation, sensitization or asthma, skin sensitization or allergic contact dermatitis, and eye irritation. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1915.1026(c): Employees were exposed to an airborne concentration of chromium (VI) which exceeded 5 micrograms per cubic meter of air, as an 8-hour time-weighted average: a) 1818 Brown Ave., Norfolk, VA 23504, Vessel APL-50: On or about January 4, 2015, and times prior thereto, employees were exposed to chromium (VI) in excess of the 8-hour time weighted average up to 32 micrograms/m3, approximately 6.4 times the OSHA Permissible Exposure Limit, while performing plasma cutting, exposing employees to increased risk of lung cancer, airway sensitization or asthma. This violation was documented on a correspondence from Marine Chemist & Environmental Consultants, Inc., to Lyon Shipyard where personal sampling was performed for approximately 421 minutes, on or about January 2, 2015. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
