29 CFR 1915.75(d): Railings approximately 42 inches in height, with a midrail, were not provided on the edges of wing walls of floating dry docks or on edges of graving docks: a) Lyons Shipyard: On or about 10/13/2021, employees were working from the wing wall of marine railway #1 repositioning winches without a guardrail system on the vessel side of the wing wall as a result were exposed to a 24ft fall hazard. Note: Sections of the railings may be temporarily removed where necessary to permit line handling while a vessel is entering or leaving the dock. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1915.77(c):- When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, either scaffolds or a sloping ladder, meeting the requirements of Subpart E- Scaffolds, Ladders, and Other Working Surfaces, were not provided to afford safe footing, or protected by a safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: a) Lyons Shipyard: On or about 10/13/2021, employees were working from the wing wall of Marine Railway #1 repositioning winches approximately 3ft from an unguarded edge without fall protection that resulted in employees exposed to a 24ft fall hazard onto the railway deck. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
