29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a) At Front of House Pike Road, Alabama:  On or about February 24, 2015 and at times prior; the employer was observed standing on the top step of an portable a-frame ladder exposing himself to a fall hazard of 8 feet to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At Lot 65 Providence Subdivision Pike Road, Alabama:  On or about February 24, 2015 and at times prior the employer allowed his employees to walk the top plate of a framed home without fall protection exposing his employees to a fall hazard of 21 feet to the ground below.  Simon Pioquinto dba Simon Pioquinto was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number1016886, citation number1, item number1, and was affirmed as a final order on February 17, 2015, with respect to a workplace located at Lot 105, Morgan Woods, Auburn, AL 36830.
