29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:  (a) Front of Building Ground - Workers were conducting framing activities and storing equipment/construction materials beside two unguarded rebars in which they could have tripped onto, on or about March 17, 2015.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:  (a) 2nd Floor Stairway - Workers were using a stairway with nine risers and no handrail  to conduct framing work and were exposed to a 10 feet 2 inches fall hazard on or about March 17, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) Rear, 2nd floor - Work was observed in an unguarded window opening loading wood without using fall protection and was exposed to 15 feet 7 inches fall hazard onto the gravel, wood, and cinder block below, on or about March 18, 2015.  (b) Rear, 3rd Floor - Workers were conducting framing activities near unguarded window openings with ledges 21 inches from the floor, without using fall protection and were exposed to a 26 feet 7 inches fall hazard onto the wood, gravel and cinder block below, on or about March 17, 2015.  (c) 3rd Floor - Workers were conducting framing activities while working off of a platform and were exposed to a 10 feet 10 inches fall hazard without using fall protection, on or about March 17, 2015.  Oscar Cruz Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1042573 citation number 1, item number 1 and was affirmed as a final order on 4/16/2015, with respect to a workplace located at 911 12th Street, NE Washington, DC 20002.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
