29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) Rear of Structure, Second and Third Levels - On or about 11/26/2019  On or about 11/26/2019 Workers framing a four level multi-unit residential structure were standing on the different levels passing wooden beams up to one another, and none of the workers exposed to falling debris or materials were wearing head protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph b 1926.501 (b):    a) Rear of Structure, Second and Third Levels - On or about 11/26/2019 workers were exposed to fall hazards of approximately 20 to 30 feet while standing on the unguarded edges of the second and third levels of a townhouse passing wooden beams up to the worker on the next upper level without using fall protection.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
