29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. At the East Side, an employee installing roofing tiles on a 7:12 pitch roof is exposed to a 14 feet fall hazard to a lower rooftop level, without the use of personal fall arrest system, safety net system or guardrail system. b. At the West Side, an employee installing roofing tiles on a 7:12 pitch roof is exposed to a 27 feet fall hazard to a lower rooftop level, without the use of personal fall arrest system, safety net system or guardrail system. c. At the West Side, an employee installing roofing tiles on a 7:12 pitch roof is exposed to a 14 feet fall hazard to a lower rooftop level, without the use of personal fall arrest system, safety net system or guardrail system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on March 24, 2015, when employees were installing roofing tiles of a residential house at 5381 Bentpine Cove Road, Jacksonville, Florida 32224 without fall protections and were exposed to fall hazards of 14 and 27 feet above the lower level. Cirilos Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 998448, citation number 01, item number 001 and was affirmed as a final order on December 01, 2014, with respect to a workplace located at 3100 Lucena Lanelot 55, Jacksonville, FL. Cirilos Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 977080, citation number 01, item number 001 and was affirmed as a final order on June 20, 2014, with respect to a workplace located at Lot 19, Saint Augustine FL. Cirilos Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 965990, citation number 01, item number 001 and was affirmed as a final order on May 13, 2014, with respect to a workplace located at Waterside Point, Groveland FL. Cirilos Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 943717, citation number 01, item number 002 and was affirmed as a final order on February 18, 2014, with respect to a workplace located at 1205 Legg Drivelot 1130, Apopka FL. To abate this violation, the employer must ensure that all employees wear appropriate fall protection or install a guardrail or safety net system when an employee works above 6 feet off the surface. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including and explanation of how these steps protect its employees from fall hazards.
