29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were not maintained in a legible condition:    (a)  A Daewoo G30P LP Powered forklift #8 utilized in the fabrication shop had a nameplate that was illegible.      (b)  A Skytrak Model No. 80422 S/N 11320 utilized in the storage yard had a load chart that was partially worn off and illegible.

29 CFR 1910.178(q)(6): Powered industrial trucks were altered so that the relative positions of the various parts were different from what they were when originally received from the manufacturer, by the addition of extra parts not provided by the manufacturer, or by the elimination of any parts without the manufacturer's approval:  (a)  A Daewoo G30P LP Powered forklift #8 utilized in the fabrication shop had the seatbelt removed.    (b)  A Skytrak Model No. 80422 S/N 11320 utilized in the storage yard had the seatbelt removed.    (c)  A reconditioned Skytrak Rough Terrain forklift utilized in the storage yard had the angle indicator on the telescopic boom removed.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:    (a)  A Dreis & Krump Mfg. Co. Mechanical Press Brake did not have any form of machine guarding to prevent operators from accessing the point of operation during the operating cycle.      (b)  A Cincinnati 230 ton Hydraulic Press Brake did not have any form of machine guarding to prevent operators from accessing the point of operation during the operating cycle.    (c)  A Edwards Mfg. Co. "Jaws IV" Hydraulic Ironworker did not have adequate machine guarding to prevent operators from accessing the point of operation of the punch, shears, and notcher during the operating cycle.  The guards provided had openings exposing employees to the point of operation.       (d)  A Wysong and Miles Co. Model 1225 Shear did not have adequate machine guarding to prevent operators from accessing the point of operation during the operating cycle.  The guard installed was approximately 2.5" above the work table allowing employees to access the material clamps and the shear.
