29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a- 217 Mantoloking Road, Brick NJ: Employees, not wearing head protection, were exposed to struck by hazards that were being thrown/falling from an overhead distance in excess of 19 feet above.  The exposed employees were performing clean up activities at the time of the exposure.  Condition observed on or about 04/28/15.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    a- Front Roof Facing Road, 217 Mantoloking Road, Brick NJ: Employees, not wearing fall protection, were exposed to fall hazards in excess of 19 feet to the ground surface below when performing roof shingle rip, tear, replace, and other related activities from a residential structure's roof with a pitch of approximately 8 on 12.  Condition observed on or about 04/28/15.     b- Back Roof Center Of House, 217 Mantoloking Road, Brick NJ: Employees, not wearing fall protection, were exposed to fall hazards in excess of 19 feet to the ground surface below when performing roof shingle rip, tear, replace, and other related activities from a residential structure's roof with a pitch of approximately 4 on 12.  Condition observed on or about 04/28/15.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)    a- 217 Mantoloking Road, Brick NJ: Employees, not wearing fall protection, were exposed to fall hazards in excess of 19 feet to the ground surface below when performing roof shingle rip, tear, replace, and other related activities from a residential structure's roofs with pitches ranging from approximately 4 on 12 up to approximately 8 on 12.  Several of these exposed employees had not received any fall protection training from the company at the time of the worksite inspection.  Condition noted on or about 04/28/15.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a- East Side Of Site, 217 Mantoloking Road, Brick NJ: Employees were exposed to fall hazards in excess of 19 feet to the ground surface below when utilizing an aluminum extension ladder whose side rails did not extend at least three feet  above the landing surface of the ladder.  Condition observed on or about 04/28/15.     b- West Side Of Site, 217 Mantoloking Road, Brick NJ: Employees were exposed to fall hazards in excess of 19 feet to the ground surface below when utilizing an aluminum extension ladder whose side rails did not extend at least three feet  above the landing surface of the ladder. 29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:    a- East Side Of Site, 217 Mantoloking Road, Brick NJ: Employees were exposed to fall hazards in excess of 19 feet to the ground surface below when utilizing an aluminum extension ladder (to access and egress the roof of a residential structure) that contained visibly damaged rungs.  Two of the four employees using this ladder had not received any ladder hazard identification training from the company.  Condition noted on or about 04/28/15.     b- West Side Of Site, 217 Mantoloking Road, Brick NJ: Employees were exposed to fall hazards in excess of 19 feet to the ground surface below when utilizing an aluminum extension ladder (to access and egress the roof of a residential structure) that contained visibly bent side rails of the ladder's fly section.  The employees using this ladder had not received any ladder hazard identification training from the company. Condition noted on or about 04/28/15.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
