29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. At the time of the inspection on or about 22 May 2015, six (6) employees of J & H Exteriors, subcontracted by CJs Roofing LLC, were observed working on a residential roof located at 645 Castle Ridge Dr. Ballwin, MO 63021 without the use of adequate fall protection. All employees on the roof were engaged in tear off of layers of roofing material while on top of the building that measured 20 feet from the ground to the eave and an additional 10 feet to the peak with a 8/12 pitched slope.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. At the time of the inspection on or about 22 May 2015, six (6) employees of J & H Exteriors were observed working on a residential roof located at 645 Castle Ridge Dr. Ballwin, MO 63021. All employees working on the house utilized the one (1) access ladder to move material up to the roof top throughout the day. The height measured 20 feet from the ground to the eave and an additional 10 feet to the peak with a 8/12 pitched slope. The access ladder did not extend 3 feet above the upper landing surface.
