Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about May 29, 2015, for the employees exposed to struck-by hazards while lifting and moving a CMS Buggy utilizing rigging equipment with a missing hook throat latch at 1820 North Plum Avenue, Brandon, South Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be for the employer to ensure rigging equipment hooks have throat latches as referenced in ASME B30.10-2014, HOOKS, Section 10-2.10: INSPECTION, REMOVAL, AND REPAIR, paragraph 10-2.10.5 Removal Criteria which states Hooks shall be removed from service if damage such as the following is visible and shall only be returned to service when approved by a qualified person: (i) Inoperative latch (if provided) any damaged latch or malfunctioning latch that does not close the hooks.
