29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) Right Side, Front of Structure - Worker standing on the third level scaffold platform that only had two 10" wide wood planks, leaving approximately a 30" open area , exposed to a fall of approximately 20' on or about 6/10/2015. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates, mud sills or other adequate firm foundation: a) Front Ground Level of Structure - Scaffold support poles/legs of a five level, four buck scaffold were sitting directly on a 2"x10"x10' piece of lumber placed on a stack of bricks, exposing workers to a fall of approximately 20' onto the scrap material and concrete below, on or about 6/10/2015. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

Oscar Cruz Construction was previously cited for a violation of this occupational safety and health standard or its equivalent (1926.501(b)(13)) which was contained in OSHA inspection number 1018431, citation number 2, item number 2, and was affirmed as a final order on 04/16/2015, with respect to a workplace located at, 411 Ridge Street NW Washington DC 20001. Oscar Cruz Construction was previously cited for a violation of this occupational safety and health standard or its equivalent (1926.501(b)(13)) which was contained in OSHA inspection number 986455, citation number 1, item number 3, and was affirmed as a final order on 11/17/2014, with respect to a workplace located at, 2840 Belair PL., NE, Washington DC 20018. In accordance with 29 CFR 1903.19(d), abatement certification is required for these violations (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.
