29 CFR 1910.178(l)(1)(i): The employer had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by completion of the training and evaluation specified in paragraph (l) [Reference 29 CFR 1926.602(d) for construction]:    a.  On or about June 29, 2015 on the south side of a commercial structure, the employer did not ensure that an employee operating a JLG 10,000 lbs. forklift had been trained and evaluated, exposing employees to struck-by and crushing hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a.  On or about June 29, 2015, on north side of a new commercial construction frame structure, an employee taking measurements and walking around the edges was not protected from a 21 feet 8 inch fall hazard by the use of a personal fall protection system.    b.  On or about June 29, 2015, on east side of a new commercial construction frame structure, two employees taking measurements and installing framing materials on the edges were not protected from a 23 feet 8 inch fall hazard by the use of a personal fall protection system.    c.  On or about June 29, 2015, on south side of a new commercial construction frame structure, two employees removing wood from a forklift near the edge were not protected from a 22 feet 2 inch fall hazard by the use of a personal fall protection system.    Action Concrete Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 911300, citation number 01, item number 01 and was affirmed as a final order on September 19, 2013 with respect to a workplace located at 3311 Bradley St., Huntsville, AL 35805.
