29 CFR 1910.26(c)(2)(vii): Ladders having defects were not taken out of service or set for repair by the maintenance department or the manufacturer. A.) United Refining Company dba Kwik Fill/Red Apple - On or about 7/8/15, and at times prior thereto, an employee was utilizing a 20 ft. metal extension ladder that had anti-slip tread material partially missing from the ladder's support feet. Employees utilized the ladder for activities that included, but were not limited to, cleaning the posts. B.) United Refining Company dba Kwik Fill/Red Apple - On or about 7/8/15, and at times prior thereto, an employee was utilizing a 20 ft. metal extension ladder that was missing the warning labels/stickers. Employees utilized the ladder for activities that included, but were not limited to, clearing the posts.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. A.) Kwik Fill/Red Apple; 1040 W. Mahoning, Punxsutawney, PA - On or about 7/6/15 and time prior thereto, the company did not report a work related hospitalization within 24 hours of it occurring. The hospitalization occurred on or about 7/4/15 at 1:30 PM. The hospitalization was not reported to OSHA until 7/6/15 at 1:20 PM.
