29 CFR 1926.300(c): Employees using hand and power tools and exposed to the hazard of falling, flying, abrasive, or splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment.   a) Jason Westhoven and Associates, LTD on or about July 15, 2015, at the address of 308 E. 2nd St. Defiance, OH: The employer did not ensure employees were provided with proper eye protection while operating pneumatic nail guns to fasten asphalt shingles. Employees were exposed to potential flying object hazards while operating the pneumatic gun.  Jason Westhoven and Associates, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.300(c), which was contained in OSHA inspection number 98313, citation number 1, item number 1 and was affirmed as a final order on December 6, 2011, with respect to a workplace located at 248 Kolbe Napoleon, OH.     Jason Westhoven and Associates, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.300(c), which was contained in OSHA inspection number 920425, citation number 1, item number 1 and was affirmed as a final order on August 16, 2013, with respect to a workplace located at 1401 Wren St. Bowling Green, OH.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  (a) Jason Westhoven and Associates, LTD on or about July 15, 2015, at the address of 308 E. 2nd St. Defiance, OH: The employer failed to ensure the supported scaffolding level from which employees were performing roofing work was fully planked. The employer had applied both 12 and 16 inch wide aluminum picks (working platforms) across 5 ft. wide scaffolding frames. The use of 12 and 16 inch platforms left the remaining width of the 5 ft. frame open to the ground below exposing the employees to a 14 ft. fall.  Jason Westhoven and Associates, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 98313, citation number 1, item number 2a and was affirmed as a final order on December 6, 2011, with respect to a workplace located at 248 Kolbe Napoleon, OH.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and/or walkway was not at least 18 inches (46 cm) wide:  (a) Jason Westhoven and Associates, LTD on or about July 15, 2015, at the address of 308 E. 2nd St. Defiance, OH: The employer failed to ensure the working platform(s) supported by welded frame scaffolding in which employees were operating, was at least 18 inches wide. Employees performing roofing work from both 12 and 16 inch wide aluminum picks (working platforms) were exposed to a 14 ft. fall to the ground below.   Jason Westhoven and Associates, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(b)(2), which was contained in OSHA inspection number 98313, citation number 1, item number 3a and was affirmed as a final order on December 6, 2011, with respect to a workplace located at 248 Kolbe Napoleon, OH.

Employees performing roofing work from a scaffolding platform without standard railing were exposed to a 14 ft. fall to the ground below.  Jason Westhoven and Associates, LTD was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 98313, citation number 1, item number 3b and was affirmed as a final order on December 6, 2011, with respect to a workplace located at 248 Kolbe Napoleon, OH.
