29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat. A.) Heath Oil, Inc., 5609 Pennsylvania State Route 8, Harrisville, PA 16038, on or about August 27, 2015 and times prior thereto: Employees were performing servicing and maintenance on empty tanks that contained residual flammable liquids, including, but not limited to, natural gas condensate fuel, and there associated flammable vapors. Service and maintenance activities included, but were not limited to, removal of manhole covers for ventilation of the tanks. Prior to the start of the service and maintenance activities, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Ignition sources included, but were not limited to, a Dodge Caravan.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: A.) Heath Oil, Inc., 5609 Pennsylvania State Route 8, Harrisville, PA 16038, on or about August 27, 2015 and times prior thereto: Employees were performing servicing and maintenance on empty tanks that contained residual flammable liquids, including, but not limited to, natural gas condensate fuel, and there associated flammable vapors. Service and maintenance activities included, but were not limited to, removal of manhole covers for ventilation of the tanks. The employees were not wearing flame resistant clothing when working near flammable liquids and flammable vapors during tank cleaning preparatory operations. B.) Heath Oil, Inc., 5609 Pennsylvania State Route 8, Harrisville, PA 16038, on or about August 27, 2015 and times prior thereto: Employees that performed work operations in process areas/re-refining areas, and conducted service/maintenance work were not wearing flame resistant clothing. The employees were potentially exposed to flash fires from flammable liquids/vapors.

Heath Oil, Inc., 5609 Pennsylvania State Route 8, Harrisville, PA 16038, on or about August 27, 2015 and times prior thereto: Employees were potentially exposed to flash fire from flammable liquids/vapors while performing several work operations in process areas/re-refining areas, and conducting service/maintenance work such as tasks associated with tank cleaning. Employees were not wearing flame resistant clothing while working in process/re-refining areas, and performing service/maintenance work. A PPE hazard assessment was not conducted to determine the need for flash resistant clothing where flammable liquids and vapors could potentially be present during work operations.
