Diversified Coatings, Inc., dba Allegheny Coatings; spray booth area - On or about 10/15/15 and at times prior thereto, approximately 3 employees were operating 3 different Toyota industrial fork trucks, without wearing a seat belt or restraint device.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. Capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly: A.) Diversified Coatings, Inc., dba Allegheny Coatings - On or about 10/15/15 and at times prior thereto, forklift attachments (dumper bins) were utilized on forklifts that that included, but were not limited to, Toyota forklift. The employer had not obtained the forklift manufacturer's approval prior to using the attachment. In addition, plates on the forklift were not changed to reflect the attachment.
