29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Inside First Floor, Left Side of Structure - Workers used a series of ladders to gain access to the upper level and roof that extended through unguarded floor/ceiling holes openings, exposing workers to a fall of approximately 9' to the next lower plywood sub-floor level on or about 2/2/2016.  b) Center Roof, Rear of Structure -  Three workers working on the roof were not protected from falling approximately 30' to the ground and scrap material below on or about 2/2/2016.  Oscar Cruz Construction was previously cited for a violation of this occupational safety and health standard (1926.501(b)(13)) which was contained in OSHA inspection number 1073461, citation number 1, item number 1, and was affirmed as a final order on 10/09/2015, with respect to a workplace located at, 422 58th Street NE, Washington DC 20019.  Oscar Cruz Construction was previously cited for a violation of this occupational safety and health standard (1926.501(b)(13)) which was contained in OSHA inspection number 1042573, citation number 1, item number 1, and was affirmed as a final order on 04/16/2015, with respect to a workplace located at, 911 12th Street NE Washington DC 20002.   In accordance with 29 CFR 1903.19(d), abatement certification is required for these violations (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
