OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard:  a. On the 4/12 pitched roof of a residential property, an employee was connected to a vertical lifeline that was tied in knots at the anchorage point exposing the employee to a 9 foot 8 inch fall hazard, on or about 2/18/16.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  a. On the 4/12 pitched residential roof an employee's lifeline was rigged in a manner that would not prevent the employee from free falling and impacting the lower level, exposing the employee to a 9 foot 8 inch fall hazard, on or about 2/18/16.
