29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On 3/14/16, at the shop on 212 Redwood Lane in Manheim, PA, the employer did not develop and implement a written chemical hazard communication program for employees working with, and exposed to hazardous chemicals used in polishing and cleaning automobiles, including Ardex High Def #2, Ardex Buster 6235 Cleaner, Impact Wheel Cleaner, Ardex 4212 Seal B or Ardex Stereo Glaze #2.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

(b) On 3/14/16, at the shop on 212 Redwood Lane in Manheim, PA, a container of Snappy used in the shop was not labeled with the hazard warning.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On 3/14/16, at the shop on 212 Redwood Lane in Manheim, PA, the employer did not provide information as required by this paragraph on the contents of 1910.1200 to employees working with, and exposed to hazardous chemicals used in polishing and cleaning automobiles, including Ardex High Def #2, Ardex Buster 6235 Cleaner, Impact Wheel Cleaner, Ardex 4212 Seal B or Ardex Stereo Glaze #2.    (b) On 3/14/16, at the shop on 212 Redwood Lane in Manheim, PA, the employer did not provide training as required by this paragraph pertaining to the hazards of the chemicals that employees were working with, or how employees could protect themselves from those hazards.  Employees were exposed to hazardous chemicals used in polishing and cleaning automobiles, including Ardex High Def #2, Ardex Buster 6235 Cleaner, Impact Wheel Cleaner, Ardex 4212 Seal B or Ardex Stereo Glaze #2.    Abatement certification required within 10 days after abatement date. 29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  (a) On 3/14/16, at the shop on 212 Redwood Lane in Manheim, PA, the employer provided Dukal 1571 N95 filtering facepiece respirators for employees to use voluntarily without employees being provided with the information in Appendix D to 1910.134.
