Professional ERA Construction, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard, 29 CFR 1910.1200(e)(1), which was contained in OSHA Inspection number 1133223, Citation number 02, Item number 001, issued on August 26, 2016. The employer failed to provided abatement certification for this citation within 10 calendar days after the abatement date, exposing employees to physical injury and health hazards.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a. On or about March 17, 2016, at a residential home construction site, two (2) employees using pneumatic type nailers to install residential framing and sheathing materials were not using eye protection and were exposed to eye injuries caused by airborne debris generated by the nailing process.

29 CFR 1926.152(a)(1): Containers other than approved metal safety cans or DOT approved containers were used for the handling and use of flammable liquids in quantities of 5 gallons or less:  a. On or about March 17, 2016, at a residential home construction site, the employer did not provide approved gasoline containers to ten (10) employees who used and stored approximately two (2) gallons of gasoline in a portable containers made from plastic-type construction, thereby exposing the employee to burn hazards from open fires.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a. On or about March 17, 2016, at a residential home construction site, on a steep porch roof with a 6:12 pitch, three (3) employees were installing roofing paper and were not protected by any form of fall protection while exposed to a ten (10) foot fall hazard to the ground below.  b. On or about March 17, 2016,  at a residential home construction site, an employee stepped through the home's exterior wall framing to install exterior sheathing to the second story wall and was not protected from an eleven (11) foot, four (4) inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternative fall protection systems or plans.  c. On or about March 17, 2016, at a residential home construction site, two (2) employees stood at the unprotected edge of the home's second story floor and were not protected from an eleven (11) foot, six (6) inch fall hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternative fall protection systems or plans.

On or about March 17, 2016, at a residential home construction site, the employer did not have a written hazard communication program and allowed ten (10) employees to use hazardous chemicals such as, but limited to gasoline and exposed them to physical injury and health hazards.
