29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a). On or about August 9, 2016 employees working on a new residential construction project and traversing the ladder to gain access to the second floor were exposed to falls in excess of 9 feet to the ground below because the 11 foot wide ledge where the ladder was positioned was not protected with guard rails, mid rails or safety nets.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a). On or about August 9, 2016, at a new residential construction project, on a steep slope, 6:12 pitch roof truss system, two (2) employees were securing roof trusses and bracing and were not protected by any form of fall protection while exposed to a 22 foot fall hazard to the ground below.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete.  a). On or about August 9, 2016 employees working at a new construction residential project were exposed to several fall related hazards that should have reasonably been recognized and corrected if proper training and retraining of the employees had been conducted by the employer.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) On or about August 9, 2016, employees were utilizing a portable aluminum extension ladder to gain access to the second floor of the construction project and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  a) On or about August 9, 2016 employees working on the roof trusses were exposed to falls in excess of 9 feet to the surface below because they were using an 8 foot portable A frame ladder in the closed position leaning against the exterior wall of the structure to gain access to the truss systems.
