29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: a) Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This violation was most recently observed at Maple Shade Estates, Lot 36, Easton, PA on April 8, 2016, when employees engaged in framing work were working at the unprotected edges of a residential roof, approximately 8 to 18 feet above a lower level on an 8 in 12 pitch, without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard.

This violation was most recently observed at Maple Shade Estates, Lot 36, Easton, PA on April 8, 2016, when employees engaged in framing work were using pneumatic nail guns, without utilizing any means of eye protection. The employer's ongoing obligation is to ensure that the necessary eye protection equipment is in use for the duration of the pneumatic tool use.
