29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about April 12th, 2016 for employees exposed to cave in hazards where the competent person failed to remove employees while replacing a water line in an unprotected trench approximately 7 feet deep in the vicinity of Fourth Avenue NE & First Street NE in Mandan, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 568300, Citation 1 , Item 3A, and was affirmed as a final order on 10/24/2012, with respect to a workplace located in a field off of Niagara Drive in Bismarck, North Dakota.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about April 12th, 2016 for employees exposed to cave in hazards while replacing a water line in an unprotected trench approximately 7 feet deep in the vicinity of Fourth Avenue NE & First Street NE in Mandan, North Dakota.
