29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) On October 5, 2022, employees were exposed to struck-by hazards while working in a trench with a depth of eight feet where the spoil pile was directly on the edge of the trench and spilling into the trench in the vicinity of 1998 66th Street SE in Bismarck, North Dakota.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On October 5, 2022, the competent person failed to remove two employees from a trench eight feet in depth where the spoil pile was on the edge and the trench had vertical walls in the vicinity of 1998 66th Street SE in Bismarck, North Dakota. Note: Markwed Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1482122, Citation 1, Item 1a and was affirmed as a final order on November 27, 2019, with respect to a workplace located East of the Intersection of 28th Avenue SE & Majestic Street in Lincoln, North Dakota.

Note: Markwed Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1482122, Citation 1, Item 1 and was affirmed as a final order on October 09, 2020, with respect to a workplace located in the vicinity of US Highway 83 & 57th Avenue NE in Bismarck, North Dakota. Markwed Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1427800, Citation 1, Item 1b and was affirmed as a final order on November 27, 2019, with respect to a workplace located East of the Intersection of 28th Avenue SE & Majestic Street in Lincoln, North Dakota.
