29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On July 7, 2020, for the employee exposed to cave-in and struck-by hazards while doing sanitary sewer work in an excavation 6 feet 7 inches in depth where protective systems were not used on a near vertical wall in the vicinity of US Highway 83 & 57th Avenue NE in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1427800, Citation 1, Item 1b, and was affirmed as a final order on November 27, 2019, with respect to a workplace located East of the Intersection of 28th Avenue SE & Majestic Street in Lincoln, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1139193, Citation 1, Item 1b, and was affirmed as a final order on April 29, 2016, with respect to a workplace located in the vicinity of Fourth Avenue NE & First Street NE in Mandan, North Dakota.
