29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On August 29, 2019, for the employees exposed to cave-in and struck-by hazards while installing a fire hydrant in an excavation approximately 8 feet in depth where protective systems were not used on a near vertical wall East of the Intersection of 28th Avenue SE & Majestic Street in Lincoln, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1139193, Citation 1, Item 1a, and was affirmed as a final order on April 29, 2016, with respect to a workplace located in the vicinity of Fourth Avenue NE & First Street NE in Mandan, North Dakota.
