29 CFR 1926.452(c)(4): End frames of tubular welded frame scaffolding were not locked together vertically by use of pins or equivalent means in areas where uplift could occur:  On or about 4/20/2016 at 1150 Dawsonville Highway Gainesville, GA; workers performing brick laying operations from the 14 foot tall scaffold were exposed to hazards related to potential scaffold collapse where the employer failed to install connecting pins where powered industrial trucks were used to lift materials such as but not limited to bricks to the working levels.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103)  On or about 4/20/2016 at 1150 Dawsonville Highway, Gainesville, GA; the employer failed to provide the Appendix D to employees that are provided dust masks for voluntary use by the employer, where chemicals including but not limited to Silica containing materials are used.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)   On or about 4/20/2016, at 1150 Dawsonville Highway, Gainesville, GA; employees supervising bricklaying operations were exposed to hazards including but not limited to exposure to Silica dust where mixing of mortar, and cutting brick and block were taking place. The employer failed to implement a Global Harmonization program.
