OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. On or about June 22, 2016, an employee was completing power washing activities from a JLG 800AJ articulating boom lift. The lift was positioned on an 11.2 sloped grade and the boom was in a position which caused an upset to occur. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.453(b)(2)(i): Lift controls shall be tested each day prior to use to determine that such controls are in safe working condition. On or about June 22, 2016, an employee was exposed to a struck-by hazard when the employer failed to ensure the lift controls were adequately tested prior to operation in accordance with the manufacturer's specification. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
