29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. WORKSHOP: The employee, having access from the scissor's lift onto, and working from the top of the working area of the No. 1 Aluminum Oven to perform repair work was not properly protected from the hazard of falling by the use of appropriate fall protection devices, guard rail systems, and/or other equivalent safe means.
