29 CFR 1926.759(a): All materials, equipment, and tools which were not in use while aloft, were not secured against accidental displacement: a) On August 25, 2016, next to the new building construction on the west side of the site, employees were conducting breaking concrete using a jack hammer. When the jack hammering was done, employees placed the jack hammer in an upright position with employees working down below in a trench exposing the employees to a struck by hazard.
