29 CFR 1910.134(c)(2)(i): Where the employer provided respirators at the request of employees, the employer did not determine that such respirator use will not in itself create a hazard. On or about September 19, 2016 employees were exposed to respiratory and skin irritation hazards where the employer provided voluntary use "3M" model 6200 half facepiece, negative pressure respirators with organic vapor cartridges but did not provide affected employees with a medical evaluation to determine that use of these respirators would not create a hazard.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. On or about September 19, 2016 employees were exposed to respiratory and skin irritation hazards where the employer provided voluntary use "3M" model 6200 half facepiece, negative pressure respirators with organic vapor cartridges but did not implement the written respiratory protection program.

On or about September 19, 2016 employees were exposed to fire and smoke inhalation hazards where the employer provided hand held portable fire extinguishers for voluntary use but did not also provide affected employees with initial and annually recurring education to inform employees of the general principles of fire extinguisher use and the hazards of incipient stage firefighting.
