29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Bossy Cart Loader: On or about October 8, 2016 and times prior, employees performed maintenance, such as adjusting the proxy sensors on the Bossy Cart Loader without developing or utilizing energy control procedures, or using alternative measures to provide effective protection. In the Alternative: 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Bossy Cart Loader: On or about October 8, 2016 and times prior, employees adjusted the proxy sensors on the Bossy Cart Loader that was not adequately guarded to prevent employees from being pulled into the machine's elevator shelving system.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) United Dairy Inc: On or about October 10, 2016 a in-patient hospitalization of an employee injured in a work-related incident was not reported within 24 hours. The employer was aware of the hospitalization on October 8 but did not report the injury until October 10, 2016.
