29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used:    a) On or about 1/25/17 at a 2 story residential construction project located at 6 Pear Tree Lane, Lancaster, New York; employees were using a ladder jack scaffold to install shingles. The scaffold brackets and platform were on the outside of the supporting ladders. The employees had to access the platform by climbing the supporting ladders and climbing around the bracket and platform.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 1/25/17 at a residential construction project located at 6 Pear Tree Lane,  Lancaster, New York;   employees performing roofing activities from a ladder jack scaffold approximately 19 feet high and were not protected from falling by a personal fall arrest system.    NO ABATEMENT CERTIFICATION REQUIRED    Brock Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1172565, citation number 1, item number 1 and was affirmed as a final order on 12/15/2016, with respect to a workplace located at 3881 Jody Court, Orchard Park, New York.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 1/25/17 at a residential construction project located at 6 Pear Tree Lane, Lancaster, New York; employees were installing shingles on the roof of a 2 story house with a 6 in 12 roof pitch and an eave height of approximately 19 feet. There was no fall protection in use.    NO CERTIFICATION ABATEMENT REQUIRED    Brock Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1132612, citation number 1, item number 1 and was affirmed as a final order on 07/25/2016, with respect to a workplace located at Darien Court Lot #90, Lancaster, New York.    Brock Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1172565, citation number 2, item number 1 and was affirmed as a final order on 12/15/2016, with respect to a workplace located at 3881 Jody Court, Orchard Park, New York.
