29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained. Westfield Electroplating Company, 68 N Elm St. Westfield, MA 01085: On or about 01/17/2017, employees wore 3M Series 6000, half facepiece respirators on a voluntary use basis while cleaning up a chemical spill from a Sulfuric and Nitric acid waste tank. The employer did not ensure that employees were medically able to wear a respirator, and that the respirators were cleaned, stored, and maintained so that the respirators did not present a health hazard to the users.
