OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards associated with improper automobile lift operations:     (a) On or about March 29, 2017, and at times prior, employees were exposed to crushing and struck-by hazards in that the lift pads on the low/mid-rise automotive lift, serial #MM9024, located in bay three, were in disrepair and in need of replacement.        Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.28(b)(8):  For repair pits, service pits, or assembly pits that were less than 10 feet (3 m) deep when fall protection systems were not required, the employer did not comply with provisions (i)-(iii) of this section:    (a)  On or about March 29, 2017, and at times prior, employees were exposed to fall hazards in excess of 4 feet into grease pits in that oil pit number three was left open with the net not in use.     Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").    Abatement Note:  In addition to the provisions listed in this section, acceptable abatement includes the use of conventional fall protection (such as guardrails) or safety net systems used in accordance with 29 CFR 1926 Subpart M.

29 CFR 1926.502(c)(5): Defective nets were used. Safety nets were not inspected at least once a week for wear, damage, and other deterioration. Defective components were not removed from service:  (a)  On or about March 29, 2017, and at times prior, employees were exposed to fall hazards where the several nets in use in the oil change pits were in disrepair including broken and unraveling netting. 29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:    (a)  On or about March 29, 2017, and at times prior, employees were exposed to hazardous chemicals in that a 50 gallon drum of all  purpose cleaner/degreaser, located in automotive pit area, was not labeled, tagged or marked with the appropriate hazard warnings.      Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").    Oilex, Inc. dba Grease Monkey was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(f)(5)(ii), which was contained in OSHA inspection number 1138029, citation number 1, item number 3b and was affirmed as a final order on June 9 ,2016, with respect to a workplace located at 421 W 29th St, Pueblo, CO  81008.

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment:  (a)  On or about March 29, 2017, and at times prior, the employer did not maintain a clear distance of three feet in front of the circuit breaker panels order to provide access for emergency maintenance.
