OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls from an unsecured work platform: Quality Welding & Fabrication, LLC - Elida, Ohio: On or about April 28, 2017, the employer did not ensure that an employee working from an elevated platform in the North Shop was protected from fall hazards of approximately 8 feet, while standing on a pallet that was not secured to the forklift forks. Among others, one feasible means of abatement is to utilize a personnel platform designed and used for its intended purpose, and that follows the ANSI B56.6-2005: Safety Standard for Rough Terrain Forklift Trucks, specifically, 5.15.1: A rough terrain forklift truck shall not be used to lift people unless there is no other practical option. If a rough terrain forklift truck must be used to lift people, the following precautions for the protection of personnel shall be taken: 5.15.1(b) be certain that the platform is securely attached to the lifting carriage and forks; 5.15.1(k) be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyard(s), etc., are in place and properly used.
