29 CFR 1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:    On or about May 23, 2017, the employer did not provide medical evaluations to determine employees' abilities to use respirators when Melt Assistant employees were required to wear powered air purifying respirators (PAPR) with a loose fitting hood during dross cake loading into semi-truck trailers.

29 CFR 1910.146(k)(2)(iv):  Ensure that affected employees practice making permit space rescues at least once every 12 months, by means of simulated rescue operations in which they remove dummies, manikins, or actual persons from the actual permit spaces or from representative permit spaces. 29 CFR 1910.146(k)(3):  To facilitate non-entry rescue, retrieval systems or methods shall be used whenever an authorized entrant enters a permit space, unless the retrieval equipment would increase the overall risk of entry or would not contribute to the rescue of the entrant:    On or about May 31, 2017, the employer did not provide retrieval systems or implement methods to ensure non-entry rescues could be performed whenever authorized entrants entered the permit space of the Hot Mill Coolant Mixing Tank. The employer did not determine is the space would increase the overall risk of entry or would not contribute to the rescue of an entrant.    Retrieval systems shall meet the requirements of 29 CFR 1910.146(k)(3)(i) through (ii) including but not limited to the following:    1) Chest or full body harness, with a retrieval line.     2) Wristlets if the employer can demonstrate a chest or full body harness is infeasible or creates a greater hazard and that the use of wristlets is the safest and most effective alternative.    3) Retrieval line shall be attached to a mechanical device or fixed point outside the permit space.    4) A mechanical device shall be available to retrieve personnel from vertical type permit spaces more than 5 feet (1.52 m) deep.

29 CFR 1910.1200(d)(1):  Chemical manufacturers and importers shall evaluate chemicals produced in their workplaces or imported by them to classify the chemicals in accordance with this section. For each chemical, the chemical manufacturer or importer shall determine the hazard classes, and, where appropriate, the category of each class that apply to the chemical being classified. Employers are not required to classify chemicals unless they choose not to rely on the classification performed by the chemical manufacturer or importer for the chemical to satisfy this requirement:    On or about May 23, 2017, the employer as a chemical manufacturer did not evaluate aluminum dross cakes to classify them in accordance with this section. The aluminum dross cakes were produced by Skana Aluminum Co. at a workplace located at 2009 Mirro Drive, Manitowoc, WI 54221 and were provided to a another company for further processing.

29 CFR 1910.1200(f)(1):  Labels on shipped containers. The chemical manufacturer, importer, or distributor shall ensure that each container of hazardous chemicals leaving the workplace is labeled, tagged, or marked. Hazards not otherwise classified do not have to be addressed on the container.  On or about May 23, 2017, Skana Aluminum Co. as a chemical manufacturer did not ensure that steel bins containing dross cakes leaving the workplace were labeled, tagged or marked.  Where the chemical manufacturer or importer is required to label, tag or mark the following information shall be provided in accordance with 29 CFR 1910.1200(f)(1)(i) through (vi):  1) Product identifier; 2) Signal word; 3) Hazard statement(s); 4) Pictogram(s); 5) Precautionary statement(s); and, 6) Name, address, and telephone number of the chemical manufacturer, importer, or other responsible party.

29 CFR 1910.1200(g)(1):  Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use:  On or about May 23, 2017, Skana Aluminum Co. as a chemical manufacturer did not develop a safety data sheet (SDS) for aluminum dross cakes they produced.  Note:  Abatement of this citation also includes the requirement for the transmittal of SDSs to all customers with the next shipment of the aluminum dross cakes.
