29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: (a) on or about 6/14/2017 maritime dock workers were exposed to roll over and struck by hazards, in that forklift drivers were not being evaluated at least once every 3 years in safe operating procedures for powered industrial trucks.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to struck-by hazard(s): (a) On or about 6/14/2017, a forklift driver and other employees were exposed to roll over and crushed by hazards when the forklift driver was observed operating the Toyota Forklift Truck #472472 without using the seat belt. The Letter of Interpretation dated October 9, 1996 addresses this condition and references ASME B56.1 consensus standards for power industrial trucks. The manufacture of this equipment has supplied seat belts. One method of abatement is for the employer to ensure employee(s) always wear seat belts while operating the Power Industrial Trucks (forklifts) and that the employer follows ASME/ANSI 56.1a-1989 Addenda to ASME/ANSI B56.1-1988; and ASME B56.1-1993. Bornstein Seafoods, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number, 1132364, citation number 1, item number 1, and was affirmed as a final order on 4/28/2016, with respect to a workplace located at 16277 Lower Harbor Dr. Brookings, OR.
