29 CFR 1910.134(c)(2)(i): When the employer determined that any voluntary respirator use was permissible, the employer did not provide the respirator users with the information contained in Appendix D to this section:     a) Jobsite:  On July 11, 2017 and at times prior thereto N95 respirators were provided by the employer for the employees voluntary use when performing wet cutting on masonry block and bricks.  The employees had not been provided with the information contained in Appendix D "Information for Employees Using Respirators When Not Required Under the Standard".   Note) Certification of corrective action is required for this item.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace:  a) Jobsite: On July 11, 2017 and at times prior thereto the employer had not performed an exposure assessment to reasonably estimate their employees exposure to respiratory hazard(s).  Employees regularly use saws to cut masonry block and/or brick.  An employee had been dry cutting on Interstate Brick which contains crystalline silica.    Note) Certification of corrective action is required for this item.

29 CFR 1910.1200(h)(1): The employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees was introduced to their work area:  a) Jobsite: On July 11, 2017 and at times prior thereto an employee used dry cutting methods on Interstate Bricks that contained crystalline silica.  Safety data sheets were not readily available on the jobsite to identify the hazards and precautions needed when handling this product.  The employee did not recognize the hazards of using this cutting method on silica containing bricks and did not take appropriate steps to eliminate the hazard.     Note) Certification of corrective action is required for this item.
