29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about August 23, 2017, during the installation of a sewer line at a commercial construction project site located at 1162 Clifton Boulevard, Cleveland, Ohio, the employer did not ensure employees were protected from excavated material posing a hazard of falling or rolling into the excavation, by placing and keeping the material at least 2 feet from the edge of a trench or by the use of a retaining device.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about August 23, 2017, during the installation of a sewer line at a commercial construction project site located at 1162 Clifton Boulevard, Cleveland, Ohio, the employer did not ensure two employees working inside a trench, with a varying depth of approximately 8 feet to 8.5 feet, were protected from cave-ins by an adequately designed protection system. The trench had near 90 degree vertical walls with a soil classification of; Cohesive Soil, Type " A".
