29 CFR 1915.74(a)(2): The employer permitted employees to board or leave a vessel by using a gangway that did not have on each side a railing with a minimum height of approximately 33 inches, measured perpendicularly from rail to walking surface at the stanchion, with a midrail and taught at all times: On October 28, 2017, at the Samoa Tuna Processing Dock: (a) The bottom left railing stanchion on the gangway was only 29 inches high, exposing employees to fall hazards. (b) The railing did not include a midrail, nor was the netting taught, exposing employees to fall hazards. (c) The top right stanchion was not installed and the next stanchion in line was not supported, nor secured, exposing employees to fall hazards.

29 CFR 1915.74(a)(6): The employer permitted employees to board or leave a vessel by using the lower end of a gangway, which overhung the water in such a manner that there was danger of employees falling between the ship and the dock, when a net or other suitable protection was not rigged at the foot of the gangway in such a manner as to prevent employees from falling from the end of the gangway: On October 28, 2017, at the Samoa Tuna Processing Dock: Employees were permitted to use the gangway without a net or other suitable protection, exposing employees to a fall hazard between the vessel and dock into the water.

29 CFR 1915.74(a)(9): The employer permitted employees to board or leave a vessel when the upper end of the means of access rested on or was flush with the top of bulwark and substantial steps properly secured and equipped with at least one substantial handrail approximately 33 inches in height was not provided between the top of the bulwark and the deck. On October 28, 2017, at the Samoa Tuna Processing Dock: The upper end of the gangway rested on top and extended past the top of the bulwark. Employees boarding and departing the vessel Cape Ferrat, used the gangway with an improperly supported handrail on one side and stairs that were not equipped with a handrail. Employees were exposed to falls while making the transition.
