29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  NETH & SON, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR EQUIVALENT, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1089858, CITATION NO.1, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL ORDER ON 10/21/2015, WITH RESPECT TO A WORKPLACE LOCATED AT BIG LOTS STORE #1520, 1980 RIDGE ROAD, WEST SENECA, NEW YORK.   a) Tops Markets, 5827 South Transit Road, Lockport, NY - On or about 11/4/17, two employees engaged in roofing work, on the flat roof, were exposed to falls of approximately 26' and 20' while working at the edge of the roof.  There was no fall protection in place.  b) Tops Markets, 5827 South Transit Road, Lockport, NY - On or about 11/4/17, an employee engaged in roofing work, on the flat roof, was exposed to a fall of approximately 20' while working at the edge of the roof.  The employee was wearing a full body harness, but was not tethered to an anchor point.  NO ABATEMENT CERTIFICATION REQUIRED
