29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: On or about April 16, 2018, and at times prior thereto, employees were conducting maintenance by accessing the hydro tester through the walking grate opening from the top floor by climbing down onto the piping approximately 15 feet high from the lowest level below, exposing employees to a fall hazard, while standing and walking on the pipes.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees: Note: The training shall include the following- 1910.147(c)(7)(i)(A) Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. 1910.147(c)(7)(i)(B) Each affected employee shall be instructed in the purpose and use of the energy control procedure. 1910.147(c)(7)(i)(C) All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out. On or about April 16, 2018, and at time prior thereto, the employer did not ensure that employees conducting maintenance activities on the hydro tester were trained in lockout as authorized personnel, exposing employees to the hazards created by unexpected reenergization of energy sources.
