29 CFR 1917.43(c)(5): Powered industrial trucks were not maintained in safe working order:    a) Seagirt Terminal, Birth #4 - Employee was operating yard hustler #577 while unloading the M/V MSC Margarita, without headlights and without work lights, on or about 04/16/2018    b) Seagirt Terminal - Employee was operating yard hustler #664 while unloading the M/V Arnold Maersk, without a passenger side headlight and the beacon light was not functioning, on or about 04/16/2018.    c) Seagirt Terminal - Employee was operating yard hustler #775 while unloading the M/V MSC Marianna, with a burned out front parking light and a beacon light that was not functioning, on or about 04/18/2018.    d) Seagirt Terminal - Employee was operating yard hustler #763 while unloading the M/V MSC Marianna, with a non-functioning beacon light, on or about 04/18/2018.    e) Seagirt Terminal - Employee was operating yard hustler #657 while moving containers around the terminal and the beacon light was not functioning, on or about 04/18/2018    f) Seagirt Terminal - Employee was operating yard hustler #586 while unloading the M/V MSC Marianna, with a rear work light burned out and the beacon light was not functioning, on or about 04/17/2018.    g) Seagirt Terminal - Employee was operating yard hustler #771 while unloading the M/V MSC Margarita, with the front parking light burned out, on or about 04/16/2018.    h) Seagirt Terminal - Employee was operating yard hustler #597 while unloading the M/V Arnold Maersk, with a non-functioning beacon light, on or about 04/16/2018.    i) Seagirt Terminal - Employee was operating yard hustler #616 while unloading the M/V Arnold Maersk, with a tail light burned out and a non-functioning beacon light, on or about 04/18/2018.    j) Seagirt Terminal - Employee was operating yard hustler #582 while unloading the M/V Arnold Maersk, with the brake lights burned out, on or about 04/18/2018.    k) Seagirt Terminal - Employee was operating yard hustler #583 while unloading the M/V Elizabeth S, with the rear working lights burned out, on or about 04/14/2018.    l) Shed 12 - Employee was operating fork lift #FL30035 to move boxes with the head lights burned out and a non-functioning beacon light, on or about 04/19/2018.    m) Shed 12 - Employee was operating fork lift #FL55011 to move boxes with a non-functioning back up alarm, on or about 04/19/2018.    n) Shed 12 - Employee was operating fork lift #FL9106 to move boxes from over the road trucks and the beacon light was not functioning, on or about 04/19/2018.    o) Shed 12 - Employee was operating fork lift #FL65002 to move steel and one front head light was burned out, on or about 04/19/2018.    p) Shed 12 - Employee was operating fork lift #FL10065 to move chain buckets and strap boxes without a backup alarm and the beacon light was non-functioning, 04/20/2018.    q) Shed 3 - Employee was operating fork lift #FL6085 to move wood for an air handling unit and the backup alarm was not function, on or about 04/20/2018.    r) Shed 3 - Employee was operating fork lift #55010 to lift container boxes and the side and rear spot mirrors were broken, over head glass was cracked and the front head light was burned out, on or about 04/20/2018.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
