29 CFR 1917.45(d)(2): The employer used a crane or derrick having a visible or known defect affecting safe operation. a.) On or about November 11, 2022, Ports America Chesapeake Berth 4- Crane #12, Employees operating the crane to lift twin 20-foot intermodal containers from ship to shore where the fall protection sensor was overridden because of multiple false alarms caused by the rain. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
