29 CFR 1926.501(b)(13): The employer did not ensure employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)K & E Construction, LLC at 340 North French Avenue, Sioux Falls, SD 57103: On or about and at times prior to May 18, 2018, the exposing employer did not ensure employees were protected from fall hazards while performing re-roofing activities on a 10-in-12 sloped roof on a single family home. Employees did not utilize fall protection when performing this work. This condition exposed employees to fall hazards of approximately 20 feet.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder lever, or above the wearer's head: (a)K & E Construction, LLC at 340 North French Avenue, Sioux Falls, SD 57103: On or about and at times prior to May 18, 2018, the exposing employer did not ensure that the dorsal D-ring was used as an attachment point on the full-body harness within a personal fall arrest system. An employee working on a 10-in-12 pitched roof with a 20 foot eave to ground height, was conducting re-roofing activities while utilizing the side D-ring located on the full body harness as an attachment point. This condition exposed the employee to injury due to excessive dynamic forces encountered during a free-fall event that would not be distributed throughout the entire body based on the use of the side D-ring.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a)K & E Construction, LLC at 340 North French Avenue, Sioux Falls, SD 57103: On or about and at times prior to May 18, 2018, the exposing employer did not ensure employees were protected from fall hazards in that, the employer had not provided employees with fall protection training prior to engaging in re-roofing activities on a 10-in-12 pitched roof. This condition exposed employees to fall hazards of approximately 20-feet.
