29 CFR 1915.72(a)(3): Portable ladders shall be lashed, blocked or otherwise secured to prevent their being displaced. The side rails of ladders used for access to any level shall extend not less than 36 inches above that level. When this is not practical, grab rails which will provide a secure grip for an employee moving to or from the point of access shall be installed:    a) On June 21, 2018, a single ladder providing access from the second level staging to the third level staging in Cargo Bay #4 on the Barge Commander did not extend 36 inches above the third level staging surface. The single ladder extended less than 1.5 rungs or 18 inches above the Cargo Bay #4 third level staging surface and there was not an object to use as a grab rail reachable from the side of the ladder used to access the third level staging surface.    b) On June 21, 2018, a single ladder providing access from Cargo Bay #2 on the Barge Commander did not extend 36 inches above the Main Deck surface. The single ladder extended less than 1.75 rungs or 26 inches above the Main Deck surface and there was not an object to use as a grab rail reachable from the side of the ladder used to access the Main Deck surface.    c) On June 21, 2018, a single ladder providing access from a north side exterior staging to the Barge Commander Main Deck did not extend 36 inches above the Main Deck surface. The single ladder extended less than 2.25 rungs or 30 inches above the Main Deck surface and there was not an object to use as a grab rail reachable from the side of the ladder used to access the Main Deck surface.

29 CFR 1910.29(k)(1)(i):  Protection from falling objects. The employers must ensure toeboards used for falling object protection are erected along the exposed edge of the overhead walking-working surface for a length that is sufficient to protect employees below;    a) On June 12, 2018, a floor opening in the Barge Commander 15 Foot Machine Room, near the pipe welding station did not have toe boards installed around the floor opening. Employees worked and passed through the level below the 15 Foot Machine Room pipe welding station area.    b) On the June 12, 2018, a floor opening near the Barge Commander 15 Foot Machine Room did not have toe boards installed around the floor opening. A ladder was seen on the level below the floor opening indicating employees working or passing through the lower area.    Fincantieri Marine Group, LLC dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(e)(4), which was contained in OSHA inspection number 985714, citation number 1, item number 2/b and was affirmed as a final order on October 8, 2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.

29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above the water, shall be provided with a railing which has a top rail whose upper surface is from 42 to 45 inches above the upper surface of the staging, platform, or runway and a midrail located halfway between the upper rail and the staging, platform, or runway.    a) On June 12, 2018, a single plank wide work surface 39 inches above the second level staging and 111 inches above the lowest point of Barge Commander Cargo Bay #4 base did not have guard rails nor were employees required to wear conventional fall protection. The two plank wide second level staging was not wide enough for a catch platform.    b) On June 12, 2018, the midrail was not present in the guardrail section the single ladder accessed the third level staging of the Barge Commander Cargo Bay #4 from the second level staging. The employer had not installed a midrail in the unused portion of the guardrail section where employees accessed the third level staging under the top rail.    c) On June 12, 2018, the midrail was not present along a staging section 24 inches from the bulkhead in the Barge Commander Cargo Bay #2. A toprail 39 inches above the third level staging surface was present between the staging and bulkhead.    Fincantieri Marine Group, LLC dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 977592, citation number 1, item number 1 and was affirmed as a final order on September 9,  2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.

29 CFR 1915.71(j)(2): Rails shall be of 2 x 4 inch lumber, flat bar or pipe. When used with rigid supports, taut wire or fiber rope of adequate strength may be used. If the distance between supports is more than 8 feet, rails shall be equivalent in strength to 2 x 4 inch lumber. Rails shall be firmly secured. Where exposed to hot work or chemicals, fiber rope rails shall not be used:    a) On June 12, 2018, several sections of the chain toprail and midrail guardrail sections on the second level and third level staging on the Barge Commander in Cargo Bay #4 had more than 3 inches of deflection.    b) On June 12, 2018, several guardrail sections of toprails and midrails on the staging in the Barge Commander bow section had more than 3 inches of deflection.    Fincantieri Marine Group, LLC dba Marinette Marine Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(e)(1), which was contained in OSHA inspection number 985714, citation number 1, item number 2/a and was affirmed as a final order on October 8,  2014, with respect to a workplace located at 1600 Ely Street, Marinette, WI.
